AirTranslator (hereafter also referred to as "app" or "Service") is a freemium app that is intended for use as is. The app is offered by the Service provider (hereafter also referred to as "we") at no cost in its free form. It offers paid in-app purchases for enhanced functionality.
By downloading or using the app, these terms will automatically apply to you. Please make sure that you read them carefully before using the app. You're not allowed to clone, copy, or modify the app, any part of the app, or our trademarks in any way. You're not allowed to attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Dr. Alper Beser.
Dr. Alper Beser is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you're paying for.
AirTranslator stores and processes voice and other data that you have provided to us, in order to provide my Service. It's your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the app won't work properly or at all.

You should be aware that there are certain things that Dr. Alper Beser will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Dr. Alper Beser cannot take responsibility for the app not working at full functionality if you don't have access to Wi-Fi, and you don't have any of your data allowance left.
Please also note that the app is subject to technical limitations of the used speech recognition service provided by Apple. As of today, any iOS device can make up to 1000 speech recognition requests per hour. We have no control over this limit that can be changed by Apple in the future.
If you're using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you're accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you're using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, Dr. Alper Beser cannot always take responsibility for the way you use the app, i.e. you need to make sure that your device stays charged. If it runs out of battery and you can't turn it on to avail the Service, Dr. Alper Beser cannot accept responsibility.
With respect to Dr. Alper Beser's responsibility for your use of the app, when you're using the app, it's important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Dr. Alper Beser accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
You are solely responsible for the content you submit to the app, including text submitted for translation. By using AI translation features, you instruct us to transmit the text to Google services (Firebase AI / Google Gemini) for processing in accordance with our Privacy Policy. Processing may occur on servers located in the United States. Do not submit content that is illegal, infringes third‑party rights, or contains sensitive personal data. AI outputs can be inaccurate, incomplete, or inappropriate for certain purposes; do not rely on them for medical, legal, financial, or safety‑critical decisions.
We may, without obligation, remove or disable access to any content that we reasonably believe violates these Terms or applicable law.
You agree not to misuse the Service, including by: reverse engineering, bypassing security, submitting malware, scraping, interfering with networks, attempting to access others’ data, using the Service for unlawful purposes, or violating platform policies (including Apple's App Store policies and App Tracking Transparency rules).
At some point, we may wish to update the app. The app is currently available on iOS. The requirements for system (and for any additional systems we decide to extend the availability of the app to) may change, and you'll need to download the updates if you want to keep using the app. Dr. Alper Beser does not promise that it will always update the app so that it is relevant to you and/or works with the iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device. Please note that all services, subscriptions, and in-app purchases (including but not limited to yearly or lifetime subscriptions) are only available as long as the app remains available in the App Store. If the app is removed from the App Store or its distribution is discontinued, access to these services and subscriptions will also end.
The Service and all materials, information, products and services included in or available through the Service are provided "as is" and "as available" for your use. The Service is provided without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Dr. Alper Beser does not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the server that makes it available are free of viruses or other harmful components.
In no event shall Dr. Alper Beser, its affiliates, or their respective directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of profits, data, use, or other intangible losses, even if Dr. Alper Beser has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, in no event shall Dr. Alper Beser's total liability to you for all damages, losses, and causes of action (whether in contract, tort, including negligence, or otherwise) exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months immediately preceding the date of the claim.
You agree to defend, indemnify, and hold harmless Dr. Alper Beser, its affiliates, and their respective directors, officers, employees, agents, and licensors from and against all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms of Use, or your violation of any rights of another party.
The Service is not intended for children under 16 years of age. By using the Service, you represent and warrant that you are at least 16 years old. If you are between 16 and 18 years old, you represent that you have obtained parental or guardian consent to use the Service.
We offer refunds in certain circumstances, such as technical issues or service unavailability. Refund requests must be submitted through the Apple AppStore.
These Terms of Use shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms of Use will be brought exclusively in the courts located in Germany, and you hereby consent to personal jurisdiction and venue therein.
Any disputes arising out of or relating to these Terms of Use or the Service shall first be attempted to be resolved through good faith negotiations. If such negotiations fail, the dispute shall be resolved through binding arbitration in accordance with the rules of the Istanbul Chamber of Commerce Arbitration Center.
If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Dr. Alper Beser regarding the Service and supersede all prior agreements and understandings.
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. These terms and conditions are effective as of 2025-10-19.
